These Customer Terms & Conditions ("Terms") govern the access to and use of the FoodBoss platform by customers placing orders for food, groceries, dairy products, sweets, pet food, and other items ("Customer", "You"). By accessing or using the FoodBoss application, website, or services, you agree to be bound by these Terms.

 

1. Definitions

• FoodBoss / Company / We / Us: FoodBoss Technologies, having its registered office at 4th Floor, Olympic Tower, Near Paras Society, Mahavirnagar, Himatnagar, Sabarkatha – 383001, Gujarat, India.

• Platform: FoodBoss mobile applications, website, APIs, and related services.

• Seller: Restaurants, grocery stores, sweet shops, dairy outlets, pet food sellers, or any merchant listed on FoodBoss.

• Delivery Partner: Independent delivery personnel who deliver orders.

• Order: A request placed by a Customer through the Platform for purchase of products from a Seller.

 

2. Eligibility & Account Registration

2.1 You must be at least 18 years of age to place orders on FoodBoss.

2.2 You agree to provide accurate and complete information during registration and keep your account details updated.

2.3 You are responsible for maintaining the confidentiality of your account credentials and all activities carried out through your account.

 

3. Nature of FoodBoss Services

3.1 FoodBoss is a technology platform that facilitates discovery of Sellers, order placement, payments, and delivery coordination.

3.2 FoodBoss does not prepare, manufacture, store, or sell food or products listed by Sellers.

3.3 The Seller is solely responsible for product quality, quantity, safety, and statutory compliance.

 

4. Orders & Fulfilment

4.1 Orders placed through the Platform constitute a binding request once confirmed.

4.2 Availability, pricing, and preparation time are determined by Sellers and may vary.

4.3 FoodBoss reserves the right to cancel or refuse any order due to unavailability, technical issues, suspected fraud, or regulatory reasons.

 

5. Pricing, Taxes & Charges

5.1 Prices listed are determined by Sellers and may include applicable taxes.

5.2 Additional charges such as packaging fees, platform fees, or delivery charges may apply and will be displayed at checkout.

5.3 Final payable amount may vary due to item substitutions or weight-based products (especially groceries and dairy items).

 

6. Payments

6.1 Payments may be made through online payment methods or Cash on Delivery (where available).

6.2 For Cash on Delivery orders, you agree to provide the exact amount where possible.

6.3 FoodBoss reserves the right to disable Cash on Delivery for certain users, locations, or orders.

 

7. Cancellations & Refunds

7.1 Orders may be cancelled only within the time window shown in the app.

7.2 Orders once prepared, packed, or dispatched may not be eligible for cancellation.

7.3 Refunds, if applicable, shall be processed to the original payment method or wallet within a reasonable time.

7.4 No refunds shall be provided for taste preference, change of mind, or incorrect address provided by the Customer.

 

8. Substitutions & Shortages (Groceries, Dairy, Pet Food)

8.1 For items sold by weight or availability-based inventory, minor variations may occur.

8.2 Sellers may substitute items of equal or higher value with Customer consent.

8.3 In case of shortages, the final bill may be adjusted accordingly.

 

9. Delivery

9.1 Delivery timelines are estimates and may vary due to traffic, weather, or operational factors.

9.2 You agree to be available at the delivery location at the scheduled time.

9.3 Failure to accept delivery may result in order cancellation without refund.

 

10. Customer Responsibilities

You agree to:

• Provide accurate delivery address and contact details

• Treat Delivery Partners and Sellers respectfully

• Avoid abusive, threatening, or inappropriate behavior

• Comply with applicable laws while using the Platform

 

11. Ratings, Reviews & Feedback

11.1 You may rate and review Sellers and Delivery Partners.

11.2 Reviews must be honest and non-defamatory.

11.3 FoodBoss may remove reviews that violate platform policies or applicable laws.

 

12. Promotions, Offers & Wallets

12.1 Promotional offers are subject to specific terms and conditions.

12.2 FoodBoss reserves the right to modify or withdraw offers at any time.

12.3 Wallet balances or promotional credits may have expiry dates.

 

13. User Conduct & Prohibited Activities

You shall not:

• Misuse the Platform

• Place fraudulent or fake orders

• Abuse refund or cancellation policies

• Harass Sellers or Delivery Partners

Violation may result in account suspension or termination.

 

14. Limitation of Liability

FoodBoss shall not be liable for:

• Quality, safety, or legality of products sold by Sellers

• Delays or non-performance caused by Sellers or Delivery Partners

• Indirect, incidental, or consequential damages

 

15. Indemnity

You agree to indemnify FoodBoss against claims arising from misuse of the Platform or violation of these Terms.

 

16. Privacy & Data Protection

Your personal data is processed in accordance with the FoodBoss Privacy Policy.

 

17. Suspension & Termination

FoodBoss may suspend or terminate your account for violation of these Terms or applicable laws.

 

18. Force Majeure

FoodBoss shall not be liable for failure to perform due to events beyond reasonable control.

 

19. Governing Law & Jurisdiction

These Terms shall be governed by Indian law. Courts at Himatnagar, Gujarat shall have exclusive jurisdiction.

 

20. Product Images

Product images are managed and added/edited by sellers to showcase their offerings, actual product may vary from images.

Confirm with your seller before ordering to avoid misinformation, and ensure proper quantity and quality.

 

21. Amendments

FoodBoss may update these Terms from time to time. Continued use of the Platform constitutes acceptance of the updated Terms.
